--ACCEPTABLE USE POLICY--

Please take a moment to get familiar with our Acceptable Use Policy ("AUP"). All users must Agree with this AUP before any service is set-up, thus why you must read and agree to it while placing your order with us.

Section I: Copyright Notice
All materials and content of mcjinteractive.com are owned and copyrighted by MCJ Interactive, Inc. ("MCJ") unless otherwise noted. Use or distribution of MCJ materials, content and intellectual property including, but not limited to, custom software developed by, for use by, MCJ is strictly prohibited without written permission from MCJ.

Any customers found in violation of this copyright notice will face immediate account termination and those up their customers until further investigation. Any outside individuals found to be in violation of this copyright notice will be pursued as the law dictates.

Section II: Payment
All payments to MCJ are non-refundable including, but not limited to, Setup One-Time Fees, Recurring transactions and/or billable services, unless otherwise noted.

Section III: Customer Content
We support freedom of speech and transmission as long as the contents are legal. We will pursue any claims brought to our attention for illegal content, including but not limited to:

- Piracy tools, sites/archives
- Hacking tools, sites/archives
- illegal mp3s
- Pornography/Child pornography
- Hate sites/archives

Any content we deem inappropriate might be reason for account suspension or cancellation without prior notice. When possible, we will try and give advance notice.

You may not use your dedicated server to publish material, which MCJ Interactive determines, at its sole discretion, to be unlawful, indecent or objectionable. For purposes of this policy, "material" refers to all forms of communications including narrative descriptions, graphics (including photographs, illustrations, images, drawings, logos), executable programs, video and audio recordings.

MCJ reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.

Section IV: Unsolicited Email (SPAM)
Use of the MCJ service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending Servers account pending verification of its origination.

If a user is found to be deliberately sending SPAM through our network, a fine of $500 per incident, or $25.00 per email, whichever is greater, will be imposed on the user and the users account will be terminated. All outstanding debts will be due at the time of the accounts termination. Account refunds will NOT be provided.

Section V: Mailing List(s)
To utilize a Mailing List on our servers you must only gain email addresses via a double-opt-in method (in other words, customer requests via website, then clicks on a link in an email to activate the subscription). You may not send more than 1 message per email address, per day to any email address on the list. If using our server to send the messages your list may not have more than 200 recipients. Should you have more, you would need to notify MCJ and receive approval prior to the use. All mailing lists must have a working unsubscribe link and you must honor their request to be unsubscribed. Any failure to remove an email address from a mailing list within 72 hours of their request will result in immediate termination of your account with MCJ. Use of our servers to send email for a third party, or regarding a third party is a direct violation of our AUP / TOS and your account could be suspended/terminated at the discretion of MCJ.

If you are accused of spamming you must be able to provide solid proof that all email addresses on the list have been added by the owner of the email address or we may terminate your account.

Section VI: Harassment
Use of MCJ service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another is prohibited. Violations of this type will result in the immediate termination of the offending Servers account pending verification of its origination.

Section VII: Fraudulent activity
Use of MCJ service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as "pyramid schemes," "ponzi schemes," and "chain letters." is prohibited. Violations of this type will result in the immediate termination of the offending account pending verification of its origination.

Section VIII: IRC
IRC activity linked to any major IRC network is forbidden within our services.

Section IX: Unauthorized access
Use of MCJ servers to access or attempt to access other's accounts, or to penetrate or even attempt to penetrate security measures of our own, or other entity, is absolutely prohibited.

Third Party Accountability: MCJ customers will be held responsible and accountable for any activity by third parties, using their account, which violates guidelines created within the Acceptable Use Policy.

Your password provides access to your account. It is your responsibility to keep your password secure. Sharing your password and account access with unauthorized users is prohibited. You should take care to prevent others from using your account since you will be held responsible for such use.

Violations of these will result in the immediate termination of the offending Servers account.

Section X: Right of Refusal
MCJ reserves the right to refuse, freeze or terminate service at any time, for any reason.

Section XI: Revisions to AUP
MCJ reserves the right to revise, amend, or modify this AUP, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service).
